Terms and Conditions

 

  1. Definitions
    • “Higher” (“we”, “us”, “wearehigher”) means Higher Handbags Pty Ltd (ABN 27847570765) or any person acting on behalf of and with the authority of Higher Handbags Pty Ltd (ABN 27847570765).
    • “Customer” (“client”, “user”, “you” or “your”) means the individual who is hiring the Handbag supplied by Higher and accepts the Terms and Conditions (by checking the box that states that the customer accepts) of hiring the item. Customers must be older than 16 years of age.
    • “Bag” (“Handbag”) means the goods supplied by Higher to the Customer.
    • “Business Day” means any day of the week excluding Saturday, Sunday and Australian public holidays.
    • “Damage” (“damages”,”damaged”) means any damage including, but not limited to, a stain, mark, tear, discoloration/changes to original colour, faultiness, caused to the Handbag during the Hire Period, whilst in the possession of the Customer.
    • “Debt Collectors” means any insurer or solicitor/barrister, which Higher has appointed to collect outstanding fees owed by the Customer.
    • “Delivery Date” means the date in which the courier/postal service makes or attempts to make the delivery of the Handbag to the Customer.
    • “Dispatch Date” means the date that the Handbag is sent by Higher to the Customer by courier/postal service.
    • “Hire Period” means the duration between the Delivery Date and Return Date.
    • “Hire Fee” means the cost to hire the Handbag for the Hire Period.
    • “Payment”/“Payment Card” means Mastercard or Visa credit card.
    • “Penalty Fee” means any amount owing for; a stolen, missing or damaged Handbag and/ or the Handbag being returned after the Return Date.
    • “Personal Details” means any personal information which include but is not limited to copy of driver’s license, passport or identification card, full name, date of birth, address, phone number, email and payment card details, which the Customer has registered onto Higher’s website.
    • “Return Date” means the date by which the Customer must lodge the delivery of the Handbag with Australia Post. On this date the Customer must provide a tracking number to Higher as a proof of lodgement with Australia Post.
    • “Third Party” means anyone other than Higher and the Customer – this includes, but is not limited to a friend, family member, acquaintance or unknown persons.
  2. Agreement
    • An Agreement of Hire is formed once the Customer accepts the Terms and Conditions and makes payment of the Hire Fee.
    • The Agreement of Hire subsequently binds the customer and Higher to the accountability of the Terms and Conditions.
    • The agreement of hire is ceased once the item is returned.
  3. Orders and Payment
    • Higher accepts orders from within Australia only.
    • All customers booking an item for rent are required to create an account for security purposes. This account requires…the following information
      • Name
      • Shipping address
      • Billing address
      • Photo ID
      • Payment method
    • After the acceptance of the Terms and Conditions, the customer is directed to make payment of the hire fee via credit card (Mastercard, Visa) or PayPal. The applicable fees will be charged on the date the purchase is made.
    • You will be required to provide Higher with accurate and valid credit card details, PayPal account, and driver’s licence, or other accepted form of photo ID.
    • This credit card will provide cover for the entire scope of the Terms and Conditions, including potential fees associated with damages, theft, late return and cancellations.
    • Higher takes no responsibility for any associated fees issued by your financial institution.
    • All prices are in Australian Dollars (AUD).
  4. Cancellation
    • Cancellations must be made by contacting the customer service team.
    • Any cancellation made less than 72 hours, where the item has not been dispatched, the customer will be charged 30% of the hire fee to cover any loss that Higher will suffer due to late cancellation. The remainder of the funds will be reimbursed to the card with which the original payment was made. In the situation where the handbag has already been dispatched the full fee will be charged.
    • Any cancellation made less than 72 hours, (regardless of whether the handbag has been dispatched or not), the customer will be charged the full hire fee and bound by the Terms and Conditions of this agreement until the return of the item to Higher.
    • At their sole discretion Higher may cancel these Terms and Conditions or cancel the delivery of the item, by giving written notice. Higher will repay any fees paid by the customer. Higher will not be liable for any loss or damage incurred to the customer as a result of cancelling the order.
  5. Damages
    • If the item is returned with damages that exceeds normal wear and tear, Higher reserves the right to bill the customer the cost of repairing the item.
    • A Penalty fee may be charged to cover any lost earnings due to damages that require repairing.
    • A tax invoice will be emailed to the customer, billing any extra incurred costs. Higher, will bill the nominated credit card 24 hours after the issue of the tax invoice.
    • In the instance the credit card cannot be billed, Higher will contact the customer to organize a suitable alternative, including a repayment plan.
  6. Stolen or Unreturned goods
    • In the event that the item is stolen or unreturned, the customer will be responsible to repay Higher the full replacement value of the item.
    • In assessing the replacement value, Higher will take into account the condition of the item and the availability to re-purchase the item.
    • In the instance the credit card cannot be billed, Higher will contact the customer to organise a suitable alternative, including a repayment plan.
    • Higher reserves the right to pursue legal action and to pass on details of the customer to the Police and/or debt collection agency for prosecution.
  7. Delivery
    • Items will be sent via Express Registered Australia Post. Signature is required on delivery.
    • Shipping is free.
    • The Delivery date is to be specified by the customer.
    • The customer will receive an email notification when the item has been dispatched, with a tracking number and estimated delivery date and time.
    • The Delivery is deemed to have taken place when the item is recorded as having been delivered to the customer’s nominated address. If the customer is not present at the time of delivery, a postage notification will be left for the customer to collect and sign for the item at the nearest Post Office.
    • All orders must be placed at least 48hrs before delivery depending on delivery address. Short notice in major cities might be possible.
    • Delivery is Australia wide to both residential and business addresses, in all major cities and rural areas.
    • A tracking number will be provided to the customer.
    • The fastest method of shipping is applied to ensure you receive your item at 8pm on the specified date.
    • Delivery will take place on weekdays only.
    • The customer must make all arrangements necessary to take delivery of the item whenever tendered for delivery.
    • The item will not be left unattended and the customer will be required to sign for collection at a Post Office.
    • Any delivery date given by Higher to the customer is an estimate only. Higher will not be liable for any loss or damage incurred to the customer as a result of delivery being late.
    • The customer is required to inspect the item within five (5) hours of delivery and inform Higher of any damage or failure to comply with the expected standard of the item.
  8. Returns
    • The return date is the final date of the booked period.
    • The return date is recorded when the customer lodges the item for return through Australia Post or the nominated courier company.
    • It is the responsibility of the customer to re-package the items as directed by Higher’s return instructions. These instructions are:
      • Re-package the bag in the original dust bag that was supplied on delivery.
      • Re-package any tissue paper or bubble wrap that was used to deliver the bag.
      • Pack the bag and packaging materials in the black ‘Higher’ magnetic closure box.
      • Place the ‘Higher’ branding box in the supplied express post satchel.
    • The customer may be responsible for any damages that occur in transit.
    • The customer will be charged a minimum late fee of $60 for each late business day, until the item is returned to Higher.
    • A tax invoice will be emailed to the customer, billing any extra incurred costs. Higher, will bill the nominated credit card 24 hours after the issue of the tax invoice.
    • In the instance the credit card cannot be billed, Higher will contact the customer to organize a suitable alternative, including a repayment plan.
  9. Customer’s Responsibilities
    • The Customer shall:
      • Not hire the item to a third party.
      • Not leave the item in the care of a third party.
      • Notify Higher of any damage to the item that occurs during the agreement.
      • Ensure that the item is not lost or stolen by themselves or a third party.
      • Not attempt to clean or repair the item themselves.
      • Return the item in accordance to Higher’s re-packing instructions.
      • Return the item by the agreed return date.
      • Pay any penalty fees that are incurred over the course of the agreement.
  1. Intellectual Property
    • Higher’s visual and promotional assets, including any graphics, logos, web design, button icons, photographs, video, images and software are the property of Higher and protected by Australian and International copyright laws.
    • No material, not limited to the list above, should be reproduced without written consent from Higher.
  2. Gift cards
    • Customers can buy gift cards for themselves or third parties, redeemable on the Higher website to the amount the gift card was purchased.
    • A Higher customer account is not required to purchase a gift card
    • The customer who redeems the gift card will need a registered Higher account with credit card details to cover damages to, theft and/or lost bags.
    • The customer who redeems the gift card are bound to the Terms and Conditions and will be liable for any damages to, theft or lost bags.
    • All gift cards are issued with an expiry date exactly 26 weeks after purchase. The gift card will not be redeemable after the gift card expiry date.
    • Money left over from a partially redeemed gift card will be available on the customers account until the expiry date of the gift card.
  3. Promotions
    • Higher will issue promotional codes.
    • These codes will offer customers a discount on bag rental
    • Higher reserves the right to stop promotions and cancel promotional codes at any time after issue without notice given to any customer who received such a promotional code.
